The 48-Hour SOA Rule Ends Oct 1: What Changes for AEP

The 48-hour Scope of Appointment waiting period ends on October 1, 2026. Starting with Contract Year 2027 marketing, Medicare agents no longer have to wait a fixed 48 hours between capturing a Scope of Appointment and holding the personal marketing appointment. The SOA itself is still required, and it still has to be agreed upon and recorded before the appointment begins. What disappears is the mandatory cooling-off period. Through September 30, 2026, the current 48-hour rule still applies, so the change lands two weeks before AEP opens on October 15.

That timing makes this the biggest operational shift Medicare agents have seen in years, and most agents have not adjusted their workflow for it yet.

What the rule was

Since the Contract Year 2024 final rule, agents generally had to capture the Scope of Appointment at least 48 hours before a scheduled personal marketing appointment. And 48 hours meant 48 hours. A scope collected at noon on Tuesday meant no appointment before noon on Thursday.

There were two main exceptions. A beneficiary who walked in unannounced could complete the SOA on the spot. And if the beneficiary was within four days of the end of a valid election period, the wait was waived. Outside those, the cooling-off period applied to every scheduled appointment, whether in person, by phone, or by video.

The practical effect was a built-in delay between interest and conversation. A senior who requested information on Monday could not sit down with an agent until Wednesday at the earliest, and plenty of that interest went cold or got picked up by whoever reached them first through an exception path.

What changes on October 1

Under the CY2027 rule, the fixed wait is gone. An agent can capture the Scope of Appointment and hold the appointment the same day, even the same hour, as long as the SOA is completed and recorded before any plan-specific discussion starts.

What does not change matters just as much:

The SOA is still mandatory before every personal marketing appointment. For in-person appointments, it must be in writing. For telephonic appointments, a recorded verbal SOA still works. A scope remains valid for 12 months, and a new one is needed if the beneficiary wants to discuss products outside the original scope or meet with a different agent. Call recording and retention requirements have not gone anywhere. And carriers can hold their agents to stricter standards than CMS does, so check your carrier guidance before you change anything.

One more date to keep straight: the change is effective October 1, 2026, not earlier. Some coverage of the rule suggested a June effective date. Through September 30, the 48-hour framework still governs scheduled appointments. If you are booking appointments in late September for early October, mind which side of the line each appointment falls on.

Why this makes speed the whole game

The 48-hour rule was a built-in equalizer. It did not matter whether you called a lead in five minutes or five hours, because neither of you could hold the appointment for two days.

The lead that used to sit in a two-day holding pattern can now be a same-day sit. During AEP, every Medicare agent in the country is dialing the same seniors between October 15 and December 7. The plans have not changed that. What changed is that the first conversation can now become the appointment without a mandated pause, so being first is worth more than it has ever been.
